The "Greatness" (Velichie) political party, along with 150 parliamentary candidates, is appealing to the European Court of Human Rights (ECHR) regarding the infringement of rights during the elections held on October 27, 2024. This was revealed in a social media video by Ivelin Mihaylov, who also displayed the document related to this appeal.
Mihaylov mentioned that the basis for the appeal is the lack of access to effective judicial oversight of the elections. The appeal is directed to the ECHR and copied to the Committee of Ministers of the Council of Europe, the Venice Commission, the European Commission, and the Supreme Committee for Human Rights. It notes that the appellants have submitted a request for the complete annulment of the election results within the legally required timeframe, having reached out to all relevant institutions authorized to file a request to the Constitutional Court under Article 150 of the Constitution of the Republic of Bulgaria, including the President, the Council of Ministers, the National Assembly, the Prosecutor General, the Ombudsman, the Supreme Bar Council, the Supreme Court of Cassation, and the Supreme Administrative Court. Despite having clear evidence of electoral misconduct, none of these bodies has taken the necessary constitutional steps to present the issue to the Constitutional Court within the 14-day deadline, which has hindered any ability to contest the election results. This refusal for judicial scrutiny constitutes a breach of the right to a fair trial, the right to an effective remedy, and the principle of free and fair elections.
In their complaint, the political party "Greatness" (Velichie) and its parliamentary candidates request that the ECHR identify violations of the right to effective judicial review of the electoral process and compel the Republic of Bulgaria to establish a genuine mechanism for contesting the elections, irrespective of the Constitution. This complaint is part of the ongoing struggle to uphold the democratic process and the rule of law in Bulgaria.
